300.200 Salary - Overtime Compensation
1. Overtime must be approved in advance by the Director, except for emergencies. In the case of an emergency, notification must be not later than the following working day.
Overtime shall be paid in accordance with the Federal Fair Labor Standards Act (FLSA) and Department of Labor regulations. Should any part of this policy be in conflict with the overtime payment provisions of the FLSA, then the FLSA will prevail.
2. Definitions used to determine overtime:
A. Full-Time Employees: Overtime for full-time employees shall be considered as those hours worked in excess of 40 hours per workweek.
B. Time off for holidays, vacation, illness, or other paid leave will be counted as compensated time each week for payroll purposes but shall not be counted as hours worked for overtime pay computation.
3. Compensation:
A. Overtime compensation pay rates for nonexempt employees are based upon the actual hours worked. When more than 40 hours are actually worked during a workweek, the rate of pay for overtime shall be one and one-half times the regular rate.
B. Part-time employees will be compensated for time worked over their regular scheduled hours up to 40 hours per week at straight time. Time worked over 40 hours in a week will be compensated at the rate of time and a half.
C. Exempt employees are designated as working a non-standard workweek and are exempt from this section and the Fair Labor Standards Act overtime pay provision.
